1. Statutory Safe Harbor Commitment

Wingu Technology LLC ("Wingu," "Company," "we," "us," or "our") respects the intellectual property rights of third parties and expects users of our sovereign cloud infrastructure, customer management portals, hosted services, and web properties (collectively, the "Services") to do the same.

Pursuant to Title 17, United States Code, Section 512(c)(2), Wingu maintains a formal "Safe Harbor" framework protecting our infrastructure against copyright infringement claims arising from content transmitted, hosted, or stored by users or third parties on our network.

2. Designated DMCA Copyright Agent

In full compliance with 17 U.S.C. § 512(c)(2), notifications of claimed copyright infringement regarding material hosted or accessible via our Services must be submitted directly to our Designated Copyright Agent registered with the U.S. Copyright Office:

3. Formal Notice of Claimed Infringement (Takedown Request)

To file an effective copyright infringement notification with Wingu, the complaining party (or their authorized representative) must provide a written communication containing substantially all of the following statutory elements:

  1. Physical or Electronic Signature: A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. Identification of Copyrighted Work: Clear identification of the copyrighted work claimed to have been infringed, or, if multiple works at a single online site are covered by a single notification, a representative list of such works.
  3. Identification of Infringing Material: Clear identification of the material that is claimed to be infringing or to be the subject of infringing activity, along with information reasonably sufficient to permit Wingu to locate the material (e.g., specific URLs, IP addresses, or tenant asset identifiers).
  4. Contact Information: Information reasonably sufficient to permit Wingu to contact the complaining party, such as a physical street address, telephone number, and email address.
  5. Good Faith Statement: A statement that the complaining party has a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. Accuracy & Perjury Statement: A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Please note: Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for legal damages, court costs, and attorney fees incurred by Wingu or the target subscriber.

4. Expeditious Takedown & Subscriber Notice Procedure

Upon receipt of a valid, written DMCA Notice containing all required statutory information:

  • Wingu will act expeditiously to remove or disable public access to the material claimed to be infringing.
  • Wingu will promptly notify the affected customer, subscriber, or account holder of the action taken and provide them with a copy of the DMCA Notice.

5. Counter-Notification Procedure

If an affected subscriber believes that material was removed or disabled as a result of mistake or misidentification, the subscriber may submit a written Counter-Notification to our Designated DMCA Agent. To be effective, the Counter-Notification must contain:

  1. The subscriber’s physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled, and the location where the material appeared before it was removed or disabled.
  3. A statement under penalty of perjury that the subscriber has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
  4. The subscriber’s name, physical address, and telephone number, along with a statement that the subscriber consents to the jurisdiction of the Federal District Court for the judicial district in which the address is located (or, if outside the U.S., for any judicial district in which Wingu may be found), and that the subscriber will accept service of process from the person who provided the original DMCA Notice.

If a valid Counter-Notification is received, Wingu will forward a copy to the original complaining party. Unless the copyright owner files an action seeking a court order against the subscriber within 10 to 14 business days, Wingu may restore or re-enable access to the removed material.

6. Repeat Infringer Termination Policy

In accordance with 17 U.S.C. § 512(i) and our Acceptable Use Policy (AUP), Wingu maintains a strict policy to terminate, in appropriate circumstances and at our sole discretion, the accounts, cloud tenants, or system access of subscribers or users who are determined to be repeat infringers.

7. Modifications & Policy Hub

Wingu Technology LLC reserves the right to amend or update this DMCA / Copyright Policy at any time. Updates will be posted directly to this page. This policy forms part of our integrated legal governance framework alongside our Terms of Use, Privacy Policy, Acceptable Use Policy, and Data Processing Agreement.
